From a legal perspective, connecting offshore wind parks to onshore
electric grids is one of the central problem areas of offshore wind
energy. Given the technical and economic challenges of offshore wind
energy extension, interests of all participants are to be aligned
through the amendment of 17 a ff. EnWG. The focus of this work will be
to clarify the concrete code of duties for transmission network
operators vis-a-vis offshore wind park operators, to define the limits
of the duty of cable installation, and to specify the legal consequences
of violating this duty. Special focus will be on the right for
compensation claims of wind park operators in 17 e Abs. 2 EnWG. The work
combines the status quo of the current jurisdiction and literature with
the authors own further legal argumentation.
